1. Parties, service and language
The contract is between Momentum Gym Torrevieja, identified in the Legal Notice, and the person named in the order. It grants a personal right to use the Momentum Gym centre at Calle Concordia 81, 03182 Torrevieja, Alicante, Spain for the period and within the limits of the selected product.
Contracting is available in Spanish and English. Spanish remains available wherever Spanish law requires it; the English text is provided for understanding and requires legal translation review before approval. Nothing in these terms waives a mandatory right.
2. Products, price and duration
The product card and order summary immediately before payment control the specific product, total price, taxes, promotion, location, start date, term and recurrence. Browser-supplied amounts are never trusted; the server selects the current price. A promotion does not alter later renewals unless expressly stated.
- Monthly unlimited: access for successive 30-day periods and recurring renewal until cancellation is scheduled.
- Weekly unlimited: non-recurring access for seven days from confirmed activation.
- Ten visits: up to ten entries within the validity displayed before payment; each valid entry uses one credit.
- Day pass: non-recurring access during the exact day or period shown before payment and, where stated, limited to the selected location.
3. Order process and contract formation
The member selects a product, completes necessary details, reviews the summary, separately accepts these terms and the Gym Rules, expressly requests performance during the withdrawal period if immediate access is wanted, and continues to the payment provider. Selection and profile errors can be corrected before placing the order.
The final control must state unambiguously that the order carries a payment obligation. A contract completes only after valid acceptance and provider-confirmed payment; a loading screen, failed authorisation or unverified charge does not activate access. The accepted version, language, order, time and exact acceptance wording are retained as evidence.
4. Payment, activation and confirmation
Stripe processes payment when that provider is enabled. Momentum does not request or store a full card number. Access activates only after an authenticated payment event linked to the order. Durable confirmation must identify the product, price, term, recurrence, accepted documents and immediate-start request where applicable.
For an error, duplicate, unauthorised charge or non-activation, contact reception without sending full card data. Momentum will investigate the order and provider references and apply any refund or remedy due.
5. Access and conduct
Membership, account and QR credential are personal and may not be lent, sold, copied or used to admit another person. The QR code is short-lived and single-use. Members must follow the Gym Rules, reasonable safety directions, capacity, opening times and authorised-area limits.
Momentum may deny a particular entry or temporarily suspend access for no active entitlement, attempted fraud, immediate risk, serious breach or a legal requirement. Measures must be proportionate, recorded and reviewable; they do not permit discrimination or arbitrary cancellation of paid service.
6. Renewal, cancellation and changes
Only monthly unlimited renews automatically in the observed configuration. Future renewal can be stopped from the member profile through a route comparable to sign-up, or by writing to reception. Cancellation preserves access until the displayed end of the paid period; it is separate from account deletion, withdrawal and refund.
Material changes to price, duration or service will be notified with the legally required notice and will not operate retroactively. Where fresh acceptance is required, renewal remains paused until it is obtained. Non-recurring passes end when their time or credits expire.
7. Withdrawal, refunds and closure
Distance contracts generally carry a fourteen-day withdrawal period. The process, model wording and effects are explained at /en/legal/withdrawal. When immediate start was expressly requested and withdrawal occurs before completion, a proportionate amount for service actually supplied may be due if legal requirements were met.
The Cancellation and Refund Policy also covers duplicate charges, service not supplied, closure, activation errors and legal remedies. If Momentum materially closes without a reasonable alternative, it cannot charge for future service not provided and will offer the remedy due.
8. Health, liability and disputes
Exercise involves effort and ordinary risks. Members must use equipment as instructed, stop for pain or concerning symptoms and seek help. Momentum retains its duties for safety, maintenance, staff and care; no term excludes liability for death, injury, wilful misconduct, negligence or another right where the law prohibits exclusion.
Incidents and complaints go to reception@momentumgym.org or the establishment. Spanish law applies without excluding mandatory protections or the consumer’s competent home forum.
